Can I sue the hospital for scarring my face during surgery?
I went in for back surgery and when I got out of the operating room I had a deep scratch across my cheek. It turned out they accidentally did it during surgery when they put the mask on me or something. Now its almost 6 months later and I have this scar that is very noticeable and embarrassing. I think its reasonable to expect a surgical scar on the affected area, my back in this case. However, to wake up from surgery and have a face injury is not something I could have anticipated.
Question is: do you think I have a case against the hospital? Shouldn’t someone pay for the mistake even though that is in fact what it was? At least to have the scar removed by a plastic surgeon or something.
What do you legal eagles think about this case?
Great responces so far…what would my first step be? Get the medical records or go to a plastic surgeon and get an estimate, or go to a lawyer first? And what type of attorney?

I think they should fix your face…they made a mistake and should correct it. Ask first, sue if you don’t get what you want…usually a threat is good enough these days…talk to a lawyer.

You probably signed a release form, Hospitals are more worried about covering their butts than your health and safety. Probably not, but talk to a lawyer, you can sue anyone you want for anything.

I think they usually have you sign a waiver before surgery that ultimately takes away any liability on their part…

I think you have a great case if you can prove your assertion. You’ll probably get a nominal settlement but you’re entitled to monies if this story is correct. The liability form is meaningless if you have concrete proof.

Hotwheel, scarring somoenes face during back surgery isn’t a potential risk like in your situation.

A sore throat is a potential risk with every insertion of a breatheing tube.

if you signed a release form saying you understand the risks of having surgery, then you technically cant do anything.

i have had over 20 surgeries, and have had complications that had nothing to do with what they were operating on (ex: they scratched my throat when they pulled out my breathing tube, i couldnt talk for 3 days) and i cant do anything about it.

you CAN however call the hospital advocacy line and complain about it. make sure you know the doctors name (specifically the anesthesiologist) because as you mentioned you think you got scratched by the mask. so make sure you have HIS/HER name when making the complaint.

but as far as legally, theres really nothing you can do…sorry
